Percy Peaks Estates is a peaceful residential community protected by shared recorded covenants. The covenants run with the land and create reciprocal rights and obligations among subdivision owners.

We believe short-term rental businesses conflict with the occupancy and nuisance provisions in those covenants. We will continue to protect the shared covenants and the residential character of this community. Before you buy property here, read the recorded covenants and understand our position.

The issue

A residential community

Peaceful does not mean silent. Gatherings, celebrations, and occasional bonfires are part of life here. Our concern is repeated disruption and serious safety risks tied to operating a home as a short-term rental business.

Neighbors should not have to monitor guests or serve as the unpaid safety team for someone else's business. The operator is responsible for preventing and managing guest behavior, not nearby residents.

Official records document fireworks and gunfire late at night, ATV trespass, and property damage tied to short-term rental activity. One police report states that fireworks struck a nearby cabin and its porch, while burning embers landed in a tree above propane and kerosene tanks near a home occupied by small children.

“This conveyance is made SUBJECT TO the following covenants, conditions, agreements and restrictions, which shall run with the land, and which are made and shall exist for the mutual reciprocal benefit and protection of owners of each and every lot or tract of land in this subdivision, and shall create reciprocal rights and obligations and privity of contract and estate between the Grantees and the Grantors, their heirs, administrators and assigns.”

Occupancy

“The land conveyed herein is to be used for single family residence purposes only, except as may be expressly and otherwise approved, in writing, by the Grantors.”

Book 1612, Page 333. The deed at Book 1621, Pages 21 to 23 uses the same substantive restriction and identifies the grantors by name.

Covenant 6

Nuisance

“No noxious or offensive activity shall be carried on or upon the within conveyed land, nor shall anything be done thereon which may become a nuisance or an annoyance to adjoining or other landowners.”

Our interpretation

Short-term rental businesses conflict with both provisions

We believe using a home as a short-term rental business conflicts with both the occupancy and nuisance covenants. It substitutes a rotating lodging business for single-family residential use. In Percy Peaks Estates, it has also produced the dangerous and disruptive activity that the nuisance covenant was designed to prevent. Residents who personally knew the Grantor have stated that he designed the covenants specifically to prevent this type of neighborhood disturbance.

This is not a hypothetical dispute. The record documents years of covenant action and serious safety incidents tied to short-term rental activity.

Historical legal research, a resident petition, police reports, and Select Board minutes document this history. Residents have acted for years to protect the residential use of Percy Peaks Estates.

January 2013: An attorney researched recreational rental use and the covenants across the subdivision.
Early 2026: Residents petitioned the Select Board to take action to enforce the shared covenants of Percy Peaks Estates.
June 2026: State agencies documented fireworks, gunfire, ATV trespass, and property damage tied to a short-term rental.
July 2026: Residents brought short-term rental concerns and a deed covenant before the Select Board in public session.

Longstanding covenant concern

In 2013, an attorney researched recreational rentals and the subdivision's deeds. The attorney found materially identical covenants in almost all deeds examined and concluded that the rental activity violated the occupancy covenant.

Organized community action

Residents called emergency services, documented the incidents, and petitioned the Select Board to enforce the shared covenants. On July 1, 2026, they brought their safety complaints before the Board in public session. The meeting minutes record the covenant discussion and the residents' requests for action.
